Auction Rules for Placing an Online Bid

These Auction Rules apply to all bids submitted through this website. By registering for an account or placing a bid, you agree to these Auction Rules, the Terms and Conditions of Use, and the Privacy Policy.

If there is a conflict between these Auction Rules and the Terms and Conditions of Use, the Terms and Conditions of Use control. If you are awarded a lease and you execute a written lease agreement, the lease agreement controls property access and use and may impose additional requirements.

  1. Bid format and how annual rent is calculated
    Bids are entered as a price per acre. If you are selected as the winning bidder and you execute the lease agreement, your annual lease payment will equal your bid multiplied by the number of acres listed for that lease.

The online bid form may display an estimated annual lease payment after you enter a bid per acre. This estimate is provided for convenience only. The acreage and final payment schedule will be stated in the lease agreement.

  1. Minimum bids and acceptance
    Each lease listing shows the minimum acceptable bid per acre. Bids below the stated minimum will not be accepted.

All bids are subject to review and confirmation by Beckwith Lumber Company, Inc. and/or Tall Trees & Land, LLC. A bid confirmation email acknowledges receipt of your bid submission by the website; it does not mean your bid has been accepted, that you are the winning bidder, or that a lease has been awarded.

We may deem a bid invalid if the bidder account information is incomplete, inaccurate, or cannot be verified for contact purposes.

  1. Bids and disclosure
    Bids are displayed publicly on each lease’s page along with the bidder ID number, bid amounts, and the date and time the bid was submitted. Personal information such as the bidder’s name or email are not displayed. We are not required to disclose current or previous bid amounts, bidder identities, or bidding activity, and any such disclosure is made at our discretion.

  2. Tie bids and official time
    If identical winning bid amounts are submitted by multiple bidders for the same lease, the earliest bid received will be declared the winner.

The official time for receipt of a bid is the timestamp recorded by the website server and/or our records, not the time shown on your device. The date and time of receipt will be included in your bid confirmation email.

  1. Confirmation emails and deliverability
    Confirmation emails are typically sent shortly after a bid is submitted. If you do not receive a confirmation email:

  • check your spam or junk folders

  • whitelist emails from beckwithwv@gmail.com, @beckwithwv.com and @beckwithlumber.com

  • if not received within 24 hours, contact us to verify whether your bid was received

We do our best to ensure auctions are fair to all bidders, but we are not responsible for email delivery delays, filtering, or technical issues outside our control.

  1. Auction changes, errors, cancellations
    We reserve the right to correct errors, update information, or cancel, extend, suspend, or re-run any auction or lease listing at any time, including after bids have been submitted, consistent with the Terms and Conditions of Use.

  2. Lease term and award conditions
    Bids are for a lease term of three successive one-year periods. Payment dates and amounts will be included in the written lease agreement.

No bid award is valid and no property access is permitted unless and until:

  • a written lease agreement is signed by both lessor and lessee and returned as required, and

  • any required documentation is provided as required by the lease (including, where applicable, insurance, a member list, and signed guest waivers)

At the end of the three-year term, we may negotiate new terms with the current lessee, place the lease up for auction again, discontinue leasing, or otherwise determine future use of the property at our discretion.

  1. Failure to perform; next highest bidder
    If a winning bidder cannot be contacted, cannot honor their bid, fails to execute required documents, violates the lease, fails to make payments on time, or is refused service for any reason consistent with the Terms and lease, we may contact the next highest bidder or place the lease up for auction again.

  2. Alternate bid submission
    If you are unable to place a bid online, you may email your bid details to Greg Hively, ghively@beckwithlumber.com, 304-922-9040. Email bids are subject to these Auction Rules, the Terms and Conditions of Use, and the Privacy Policy. The time of receipt will be determined by our records.
